Terry Duffy started at CME Group almost five decades ago. Back then, the Commodity Futures Trading Commission was practically brand new.
Today, the CME Group chairman and CEO is watching that same regulator approve products he thinks deserve a much harder look. He is not keeping quiet about it.
In his latest remarks on how finance regulation has changed, Duffy pointed to three forces reshaping derivatives markets: prediction markets, 24/7 trading and perpetual futures. All three have a crypto fingerprint on them.
Hedging or gambling, and who decides
Duffy’s central concern is that the line between risk management and wagering has gotten blurry. He argues that contracts built to hedge real economic risk are increasingly hard to tell apart from event products that look a lot like bets.
Duffy wants stronger oversight of the space. Specifically, he has called for public regulatory reviews of new derivatives before they hit the market.
That puts him at odds with the current self-certification model. Under that setup, an exchange can list a new contract by certifying to the regulator that it complies with the rules, rather than waiting for a full review.
CME takes the CFTC to court over Bitcoin perps
In June 2026, CME Group sued the CFTC over the regulator’s approval of Bitcoin perpetual futures.
Perpetual futures are contracts that never expire. Instead of settling on a fixed date, they roll on indefinitely, using a periodic payment mechanism to keep their price tethered to the underlying asset.
CME’s argument is that these products function like swaps under Dodd-Frank, the post-2008 financial reform law. That classification is not a technicality. Swaps sit inside a different and heavier regulatory regime than standard futures, with its own requirements around trading, clearing and reporting.
The broader clash with regulators has also touched products like Kalshi’s Bitcoin futures, underscoring how crowded and contested the crypto derivatives approval pipeline has become.
The 24/7 question
CME responded on May 29, 2026, when it launched 24/7 trading for its crypto futures and options. The exchange has plans to extend that model further.
Duffy has gone a step beyond that. He believes nonstop trading could eventually apply to all products, not just crypto.
Duffy says that future depends on whether the banking system can operate continuously too. A market can match trades at 3 a.m. on a Sunday. Moving collateral and settling cash at that hour still runs into the reality that much of traditional banking keeps business hours.
What this means for markets and regulators
Duffy will step down as CEO on March 1, 2027, after leading CME Group for decades.
For crypto traders, the CME lawsuit is the item to watch most closely. If a court agrees that Bitcoin perpetual futures behave like swaps under Dodd-Frank, platforms offering them in the US could face a far more demanding compliance burden. If the CFTC’s approval stands, perps could become a more established fixture of regulated US crypto markets.
For prediction markets, Duffy’s push for public reviews targets the speed that has helped the sector grow. A shift away from self-certification would likely mean fewer and slower product launches, with more public argument over whether a given contract serves a hedging purpose.
CME has already shown it is willing to run crypto markets around the clock. Whether that model ever reaches other products depends on whether banks modernize their settlement hours, which puts the timeline partly outside the control of any trading venue.
